THE DEFINITION OF BOND

Another common term you will hear during the process is that an individual is “bonded out”. If an individual is bonded out, this means that the suspect relied on a professional bail bonds company to bail them out, because they did not have the means to do so themselves. This is an unsecured form of payment.

  • How does bail work?

    When a person is arrested, the court sets a bail amount. If the defendant or their family pays this amount in full, the defendant is released and must return for their court date. If they attend all required court appearances, the bail money is refunded, minus any court fees.

  • How does a bail bond work?

    If a defendant cannot afford to pay bail in full, they can contact a bail bondsman. The bondsman will post bail for them in exchange for a non-refundable fee, typically 10% of the total bail amount. The defendant must still appear in court as required, or they risk having their bond revoked.

  • Is bail always required for release from jail?

    No. In some cases, a judge may allow a defendant to be released on their own recognizance (OR), meaning they do not have to pay bail but must promise to return for their court dates. This is typically granted for low-risk offenders.

  • What types of collateral can be used for bail?

    If a defendant or their family cannot afford cash bail, they may use property, vehicles, jewelry, or other valuables as collateral. If the defendant fails to appear in court, the court may seize the collateral.
